Welcome to premiumplatesupply.com. This website is owned and operated by Premium Plate Supply, a TF Warren Company. By accessing or using our website, tools (including the Metal Weight Calculator), and services, you agree to comply with and be bound by the following terms and conditions. If you do not agree to these terms, please do not use this site.
1. Acceptance of Agreement
You agree to the terms and conditions outlined in this Terms of Service Agreement (“Agreement”) with respect to our site (the “Site”). This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the Site.
2. Services and Scope
Premium Plate Supply provides high-quality steel plate products (including Carbon, Stainless, HSLA, and Alloy) and processing services (including Plasma/Laser Cutting, Beveling, and Rolling). The information provided on this Site, including material grades and processing sequences, is for informational purposes to assist in your procurement process.
3. Use of Calculation Tools and Estimates
- Estimation Only: The Metal Weight Calculator and any other technical tools provided on the Site are for estimation purposes only.
- No Guarantee of Accuracy: While we strive for precision, calculated weights do not account for mill tolerances, kerf loss during processing, or specific alloy densities.
- Verification: Customers are responsible for verifying all dimensions and weights with a Premium Plate Supply technical representative before placing a firm order. Premium Plate Supply is not liable for engineering or construction errors resulting from the use of Site calculators.
4. Intellectual Property
The content, organization, graphics, design, compilation, magnetic translation, digital conversion, and other matters related to the Site are protected under applicable copyrights, trademarks, and other proprietary rights. The copying, redistribution, use, or publication by you of any such matters or any part of the Site is strictly prohibited.
5. Quote Requests and Orders
- Non-Binding Quotes: Submitting a "Request a Quote" form through the Site does not constitute a binding contract.
- Terms of Sale: All physical orders of steel plate or processing services are subject to Premium Plate Supply’s standard Terms and Conditions of Sale, which will be provided at the time of quoting or invoicing.
6. Indemnification
You agree to indemnify, defend, and hold Premium Plate Supply and our partners, attorneys, staff, and affiliates (collectively, “Affiliated Parties”) harmless from any liability, loss, claim, and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the Site.
7. Disclaimer of Warranties
THE INFORMATION FROM OR THROUGH THE SITE IS PROVIDED "AS-IS," "AS AVAILABLE," AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED. THE INFORMATION AND SERVICES MAY CONTAIN BUGS, ERRORS, PROBLEMS, OR OTHER LIMITATIONS. WE AND OUR AFFILIATED PARTIES HAVE NO LIABILITY WHATSOEVER FOR YOUR USE OF ANY INFORMATION OR SERVICE.
8. Limitation of Liability
Premium Plate Supply shall not be liable for any indirect, special, incidental, or consequential damages (including damages for loss of business, loss of profits, litigation, or the like), whether based on breach of contract, breach of warranty, tort (including negligence), product liability, or otherwise, even if advised of the possibility of such damages. The negation of damages set forth above is a fundamental element of the basis of the bargain between us and you.
9. Use of Information
We reserve the right, and you authorize us, to the use and assignment of all information regarding Site uses by you and all information provided by you in any manner consistent with our Privacy Policy.
10. Governing Law
This Agreement shall be treated as though it were executed and performed in the State of Alabama, and shall be governed by and construed in accordance with the laws of that State.
